1. Agreement to these Terms

These Terms of Service (the “Terms”) are a binding agreement between you and WeirdWorldMedia, LLC, a Washington limited liability company doing business as metabomap (“metabomap,” “we,” “us,” or “our”). They govern your access to and use of the metabomap websites (including metabomap.com and app.metabomap.com), our web and mobile applications, our application programming interfaces (APIs), and any related content, tools, and services (together, the “Services”).

By creating an account, clicking “I agree,” or otherwise accessing or using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Services.

Please read Sections 7 (No Medical Advice), 8 (No Warranties), and 10 (Limitation of Liability) carefully - they limit our liability and describe risks you accept by using the Services.

3. Eligibility and your account

Age. The Services are intended for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account or use the Services. The Services are not directed to, and may not be used by, children. See our Privacy Policy for more on children’s data.

Registration. Some features require an account. You agree to provide accurate information and to keep it current. You are responsible for all activity that occurs under your account.

Account security. You are responsible for safeguarding your login credentials, any API keys you generate, and any devices or third-party assistants you connect to your account. Notify us promptly at info@weirdworldmedia.com if you suspect unauthorized use. We are not liable for losses caused by unauthorized use of your account that results from your failure to keep your credentials secure.

One person, one account. Accounts are personal to you and may not be shared, sold, or transferred without our consent.

4. The Services, tiers, and changes to them

metabomap is a wellness and self-tracking tool. It helps you record and understand your own nutrition and metabolic information - for example, logging foods, meals, recipes, water, fasting sessions, exercise, body measurements, and blood-glucose or ketone readings you enter, and viewing that information back to you as logs, charts, goals, and reports. metabomap also offers optional integrations, a community area, and programmatic access.

Free and paid tiers. metabomap offers a free tier and one or more paid subscription plans (“Premium”). The features included in each tier, and the current prices, are described at checkout and on our Pricing page. We may change the features, structure, and pricing of the tiers over time; see Section 5.

No feature is guaranteed to remain free. The free tier is offered at our discretion. We may change what the free tier includes, introduce usage limits, add new paid features or tiers, and move features between the free and paid tiers, including features that were previously free. If we move a feature out of the free tier, we will give affected users reasonable advance notice by a means described in Section 16, and you may stop using the Services at any time. Your ability to export your data and delete your account is not a paid feature and will remain available to you.

Digital delivery. The Services are delivered electronically. When you purchase Premium, access is provisioned to your account promptly after your payment is authorized; there is no physical product to ship.

Changes to the Services. We are actively developing metabomap. We may add, change, suspend, or discontinue features at any time. We will use reasonable efforts to avoid materially degrading a paid feature during a term you have already paid for; if we discontinue a material paid feature, your remedy is described in Section 5.

5. Subscriptions, billing, trials, renewals, and refunds

Plans, prices, and currency. Premium may be offered on more than one billing period (for example, a monthly plan and an annual plan) and at more than one price. Current plans and prices are shown at checkout and on our Pricing page and are stated in U.S. dollars (USD) unless noted otherwise. You are responsible for any taxes that apply to your purchase.

Payment processing. Payments are processed by our third-party payment processor, Stripe. We do not receive or store your full payment card number. Your use of Stripe is subject to Stripe’s own terms and privacy policy. Card charges from metabomap appear on your statement under the descriptor METABOMAP.

Promotional codes and discounts. We may offer discount codes, founding-member pricing, or other promotional pricing. These affect the price you pay, not the features you receive. Each offer’s conditions (eligibility, expiry, what the price renews at) are stated where the offer is presented. Offers cannot be combined unless we say so, and we may withdraw an unused offer at any time.

Free trials and promotional access. We may offer time-limited access to Premium. Two kinds exist, and we will tell you which one you are getting before it starts:

• Trial with a payment method. If you provide a payment method to start a trial, we will tell you the trial length, the price after it ends, and the deadline to cancel. Unless you cancel before the trial ends, the trial automatically converts to a paid subscription and we will charge your payment method the then-current price, renewing under the terms below.
• Promotional access without a payment method. We may give an account a period of Premium at no charge and without collecting any payment details. This access simply ends at the stated time and the account returns to the free tier. There is nothing to cancel and you will not be charged.

Trials and promotional access are limited to one per person or account unless we state otherwise, are not transferable, and may be modified or withdrawn for future users at any time. We may end a trial early if we believe it is being abused.

Subscription term and automatic renewal. Premium is a recurring subscription. Unless you cancel before the end of your current term, your subscription renews automatically for another term of the same length, and we (through Stripe) will charge your payment method the then-current renewal price. We will apply any renewal-notice requirements that apply to your jurisdiction.

Cancellation. You may cancel at any time from your account settings or by emailing info@weirdworldmedia.com. When you cancel, you keep Premium access through the end of the term you have already paid for, and your subscription does not renew after that.

Refunds - our default. Except where required by law, or where a money-back guarantee described below applies to your purchase, all payments are final and non-refundable. This includes partial billing periods, unused time, and any period remaining after you cancel. We may grant a refund at our discretion in an individual case; doing so does not oblige us to do so again.

Money-back guarantee, when we offer one. We may offer a money-back guarantee on a first Premium purchase - currently 30 days from the date of your initial Premium purchase, as described on our Pricing page. If a guarantee is in effect for your purchase and you request a refund within that window at info@weirdworldmedia.com, we will refund the amount you paid for that initial purchase. Any such guarantee applies to a first Premium purchase only, once per account, and not to renewals. A money-back guarantee is a promotional offer, not a permanent term of these Terms: we may change or withdraw it at any time. The terms of the guarantee published at the time of your purchase are the ones that apply to that purchase.

If we discontinue a paid feature. If we discontinue a material paid feature during a term you have already paid for, contact us and we will, at our option, restore comparable functionality or provide a pro-rated refund for the remainder of the term.

Price and plan changes. We may change subscription prices and the plans we offer. Any price change applies to a term that begins after the change; we will give you advance notice of a change to your renewal price and an opportunity to cancel before it takes effect.

Billing problems and chargebacks. If you believe you were billed in error, please contact us first at info@weirdworldmedia.com - most issues are resolved quickly. Initiating a chargeback without first contacting us may result in suspension of your account.

6. Advertising, sponsorships, and affiliate links

Today, the Services carry no advertising. We may introduce advertising, sponsored placements, or partner offers in the future - most likely on the free tier - and we may earn commissions through affiliate links. This section tells you how we will handle that.

• Affiliate links. Some links to third-party products or services may be affiliate links, which means we may earn a commission if you buy something after following them, at no additional cost to you. Where we use them, we disclose them at or near the link. A commission never buys placement or a recommendation: what we recommend is an editorial decision, made on the merits, and we say so where it matters.
• We do not target advertising using your health data. We will not use your consumer health data - what you log, or what an integration you connect syncs to us - to select, target, or personalize advertising, and we will not share it with advertisers or data brokers. Any advertising we introduce will be contextual (based on the page or feature you are using), not based on profiling you. Data we receive from Google APIs is never used for advertising of any kind.
• Before anything changes. Before we introduce advertising to the Services, we will update our Privacy Policy to describe it and notify you as described in Section 16.
• Not an endorsement. Advertisements, sponsored content, and third-party offers are the responsibility of the businesses that provide them. We do not control and do not endorse them, and Section 12 applies to any dealings you have with them.
• Premium. Where a paid tier is described as advertising-free, we will honor that description for the term you have paid for.

7. No medical advice; assumption of risk

metabomap is not a medical device, and it does not provide medical, healthcare, or professional advice. Please read this section carefully. By using the Services, you acknowledge and accept the risks described here.

• Informational purposes only. All content and features provided through the Services - including nutritional data, macronutrient and net-carb calculations, charts, goals, targets, meal plans, recipes, articles, evidence summaries, workout suggestions, and any output of automated or AI-assisted features - are for general informational and educational purposes only. They are not medical, healthcare, nutritional, or wellness advice, a diagnosis, a treatment, or a substitute for consultation with a qualified healthcare professional.
• Consult a professional. Always seek the advice of a licensed physician or other qualified health provider before starting, stopping, or changing how you eat, fast, exercise, or take medication, and before acting on anything you see in the Services. This is especially important if you are diabetic, take blood-glucose or blood-pressure medication, are pregnant or breastfeeding, or have kidney, liver, heart, or other medical conditions. Carbohydrate restriction and fasting can change how much medication you need, sometimes within days; those doses are your prescriber’s to adjust, not ours.
• Exercise. Any exercise, workout, or movement content in the Services - including suggested routines and any observations about training balance or recovery - is general information, not a prescription. Physical activity carries risk of injury. Get medical clearance before beginning or changing an exercise program, work within your own limits, and stop if something hurts.
• Never disregard professional advice. Never disregard professional medical advice, or delay seeking it, because of something you read or calculated in the Services. If you think you may have a medical emergency, call your doctor or emergency services immediately.
• You evaluate accuracy. Nutritional and reference data may contain errors, may be incomplete, or may not apply to your specific circumstances. You are solely responsible for evaluating the accuracy, completeness, and suitability of any information before relying on it.
• Assumption of risk. You voluntarily assume all risks associated with your use of the Services and with any dietary, fitness, fasting, or lifestyle choices you make in connection with them. This acknowledgment applies to you and your heirs, successors, and assigns, and survives the end of your use of the Services.

8. No warranties

The Services are provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, we disclaim all express and implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free; that data or calculations will be accurate or complete; that defects will be corrected; or that the Services or the servers that make them available are free of viruses or other harmful components. Any material you obtain through the Services is accessed at your own discretion and risk.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

9. Your content, conduct, and the community

Your content. The Services let you create and submit content - for example, custom foods and recipes, notes, profile information, and posts, comments, and progress you share in community features (“Your Content”). You retain ownership of Your Content.

License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display Your Content solely as needed to operate, provide, secure, and improve the Services and to make Your Content available to others as you direct (for example, when you post in the community or share a snapshot). This license ends when you delete Your Content or your account, except for copies retained in routine backups for a limited period or as required by law, and except for content others have already re-shared or that must be retained to resolve disputes or meet legal obligations.

Your responsibility. You are responsible for Your Content and represent that you have the rights to submit it and that it does not violate these Terms or any law or third-party right.

Acceptable use. You agree not to:

• use the Services for any unlawful purpose or in violation of these Terms;
• post content that is false, misleading, defamatory, harassing, hateful, infringing, or that invades another person’s privacy;
• present yourself as a medical professional you are not, or give other users medical, diagnostic, or prescribing advice through community features;
• upload malware, attempt to breach or probe security, or access data or accounts that are not yours;
• scrape, crawl, or harvest data from the Services except as expressly permitted through our API;
• reverse engineer, resell, or create a competing product from the Services or our data except to the extent this restriction is prohibited by law;
• interfere with or place an undue load on the Services or their infrastructure; or
• create fake accounts, manipulate community engagement, abuse referral or promotional offers, or misrepresent your affiliation with anyone.

Moderation. We may review, remove, or restrict content or accounts that violate these Terms, but we are not obligated to monitor content, and we are not responsible for content submitted by users. Community content reflects the views of the individuals who post it, not metabomap.

10. Limitation of liability

To the fullest extent permitted by law:

• metabomap and its members, managers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.
• metabomap and its members, managers, employees, and suppliers will not be liable for any personal injury, health condition, or other harm arising from dietary, fasting, exercise, medication, or other decisions you make in connection with the Services. You accept sole responsibility for those decisions, as described in Section 7.
• Our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless WeirdWorldMedia, LLC and its members, managers, employees, and suppliers from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Services, (b) Your Content, (c) your violation of these Terms or any law, or (d) your violation of any right of a third party. We may assume the exclusive defense of any matter subject to indemnification by you, in which case you agree to cooperate with us.

12. Third-party services, integrations, and connected assistants

The Services may let you connect third-party services (for example, Fitbit or Google Health) or link out to third-party content, offers, or professionals. When you connect a third party, you authorize the exchange of the data described at the time you connect it, and your use of that third party is governed by its own terms and privacy policy. We do not control and do not endorse third-party services, professionals, advertisers, or the content they provide. Any interaction between you and a third party - including any professional you find through the Services and any purchase you make through a link in the Services - is solely between you and that third party, and we disclaim liability arising from it.

API and AI assistants. If you generate an API key or connect an AI assistant (including through the Model Context Protocol) to your account, you are responsible for what that key or assistant does with your account and data, for keeping the key confidential, and for the third-party assistant’s own terms. We may set and enforce rate limits, deprecate endpoints with reasonable notice, and suspend keys that are abused or that threaten the Services.

13. Our intellectual property

The Services - including our software, design, text, graphics, curated datasets, recipes, articles, and the metabomap name and logo - are owned by WeirdWorldMedia, LLC or its licensors and are protected by intellectual-property laws. Except for Your Content and except as expressly allowed by these Terms or by our API documentation, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own personal, non-commercial purposes. All rights not expressly granted are reserved.

Some content in the Services is generated or assisted by artificial intelligence and is labeled where we consider it material; such content is informational and subject to Section 7.

14. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if necessary to protect the Services or other users. On termination, your right to use the Services ends. Sections that by their nature should survive

• including Sections 7 through 13, 15, and 16 - survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules, and by applicable U.S. federal law. You and metabomap agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in the State of Washington, and you consent to the personal jurisdiction of those courts.

Please contact us first. Before filing any formal claim, you agree to contact us at info@weirdworldmedia.com and give us at least thirty (30) days to try to resolve the matter informally. Most disputes can be resolved this way.

Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction, and nothing waives any right you have that cannot be waived under applicable law.

16. General

• Changes to these Terms. We may update these Terms from time to time. If we make a material change, we will update the effective date above and notify you by a reasonable means (for example, by posting the new version and, where appropriate, an in-app or email notice). Changes are effective when posted unless stated otherwise; your continued use of the Services after a change means you accept the updated Terms.
• Entire agreement. These Terms and the documents they incorporate (including the Privacy Policy) are the entire agreement between you and metabomap about the Services and supersede any prior agreements on that subject.
• Severability. If any provision is found unenforceable, the rest of the Terms remain in effect and the unenforceable provision is modified to the minimum extent necessary.
• No waiver. Our failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
• Notices. We may provide notices to you by email or through the Services. You may send notices to us at info@weirdworldmedia.com.
